A BETTER ALTERNATIVE TO FORCLOSURE IN COSTA MESA CALIFORNIA REAL ESTATE!

 

 

Due to recent government incentives, short sales are becoming the darling of the distressed-property marketplace.  A short sale keeps owners out of foreclosure, because the lenders allow the homeowners to sell their house for less than they owe.

 

Banks have really sped up the process, hiring large numbers to serve the short sale specialty.  In early 2010, one of the very largest banks had more than doubled the number of short sales it approved, sometimes as quickly as 24 days.  Compare that to last year, when short sales stalled indefinitely or took more than six months to complete.

 

The biggest roadblock to approval was often a second mortgage held by the seller.  Since the primary lender must be paid first, the second lien holder could be left with nothing, and they would basically kill the sale.  But now the Home Affordable Foreclosure Alternatives (HAFA) program provides money to primary lenders who share the proceeds with the second lien holders.  HAFA also provides up to $6,000 to those secondary lenders if they release their claim. 

 

Short sales keep borrowers out of foreclosure and reduce the impact on their credit.  While foreclosure can shave 200 points off your score, the penalty for a short sale is only half of that.  Hopefully, a boom in short sales will also bring us closer to ending the ongoing foreclosure crisis.

City of Costa Mesa Council And Commission Recruitment! Need a few good men & women to help out!

The City Council of the City of Costa Mesa is currently accepting letters of interest/applications from residents who wish to serve on the City Council, the Planning Commission or the Parks and Recreation Commission. There is a possibility of one (1) vacancy on the City Council. There will also be three (3) appointment opportunities for the Planning Commission and three (3) appointment opportunities for the Parks and Recreation Commission. The City Council will be making the appointments at the January 4, 2011 City Council meeting.

The five-member City Council is the legislative and policy body for the City, charged with providing overall leadership for the City by enacting laws and allocating City resources for programs, services, and activities. The City Council is comprised of the Mayor, who is appointed from among the City Council to serve as the official head of the City and to preside over all Council meetings, and four Council Members. All five are collectively referred to as the "Council." Each Council official is elected "at large" by the public to represent all Costa Mesa residents. Costa Mesa does not have electoral districts. The potential vacant City Council position has two years remaining on an existing four-year term. Interested applicants must be residents of Costa Mesa and qualified electors. A letter of interest is required and a resume is encouraged for anyone interested in being considered for the open City Council seat.

The five-member Planning Commission is empowered to make decisions by the California Government Code. The scope of the Planning Commission’s authority includes the regulation of future growth, development, and beautification of the City with respect to public and private projects. A completed application is required and a resume is encouraged for anyone interested in being considered for the Planning Commission. Applicants must be residents of Costa Mesa and qualified electors.

The five-member Parks and Recreation Commission was established by the City Council in 1990, to consider or act upon issues, programs, user fees, and studies pertaining to parks, recreation facilities and parkways matters, or make recommendations to the City Council as specified in the Costa Mesa Municipal Code. A completed application is required and a resume is encouraged for anyone interested in being considered for the Parks and Recreation Commission. Applicants must be residents of Costa Mesa and qualified electors.

Interested individuals are encouraged to submit the requested information indicating which body they wish to be considered to: Costa Mesa City Council, P.O. Box 1200, Costa Mesa, California 92628-1200, or bring it to City Hall, 77 Fair Drive, City Manager’s Office by 5:00 p.m. Friday, December 17, 2010. Real Estate Agents Beware of Agent Connect!

This company http://AgentConnect.com does provides leads like they state, but try to get them to cancel your account and you will get taken for a ride.  I contracted with them for 3 -5 leads per month back in August of 2010, the first month they sent more than 7 leads, then in Sept they sent more leads again than what I had contracted for!  I sent them 5 emails asking them to stop over sending me leads, I called them twice and never got a return call, I only heard from them when I told Citibank to stop allowing charges from them. This company is also tied in with http://Reply.com

Do not let yourself be scamed by this company or any other company that does not return your emails or your phone calls! Call your credit card company right away and have them freeze the charges to your account!  All your emails to the company do not count, the credit card company wants a confirmation number that you cancelled your account- good luck getting it if they do not return your calls!

Please write blogs about this company and any other companies that have not provided good customer service! I was taken for about $400 by this company, at this point it is not about the money, it is about doing the right thing in business.

CONSUMER ALERT - BEWARE OF IMPOSTER LANDLORDS FROM THE CALIFORNIA DEPT. OF REAL ESTATE

This was just realeased from the California Dept. of Real Estate!  I have personally seen several of these scams take place in Costa Mesa during the past year!

 

 

 

 

 

As a result of the mortgage meltdown in California, and with many thousands of foreclosures, there are abandoned properties in communities throughout the State. Moreover, the continued economic downturn has left numerous people displaced and in need of rental housing. The California Department of Real Estate (DRE) has become aware of unscrupulous activity by some persons who hold themselves out as owners of vacant houses (and/or agents of such owners). These people prey on desperate consumers who are looking for some place to rent. These cons are able to convince potential renters into paying money, which may include a first and last month’s rent and a security deposit, as well as follow up rental payments, for a house that is not owned by the supposed landlord.

Sometimes it does not take much to fool potential tenants into believing that they are dealing with the real owner of the house. Here are some ploys these scammers use:

 They gain access to vacant houses by unlawfully breaking into the houses, changing the locks, securing the properties and giving the illusion of ownership.

 They go to great lengths to obtain documents which are used to falsely assert to prospective tenants that the houses are owned by them. For example, they sometimes access the county assessor’s website and obtain a document called a Preliminary Change of Ownership Report. Normally, this report is filed with the assessor’s office in connection with certain deeds to assist the assessor with property tax valuations. The crooks download and complete the Preliminary Change of Ownership Report document, sometimes obtaining a "filed" stamp, and then offer the document as evidence that they own the property to be rented. This might also make a prospective tenant believe that the person(s) he or she is dealing with is legitimate. Another scenario like this is where a bogus landlord makes payment of a small tax lien on a house not owned by them, and then provides evidence of that payment as so-called proof that he or she owns the house.

 They send out bogus letters, emails, and other documents which appear legitimate, instructing existing tenants to cease rental payments to the property owner and redirecting the tenants to pay their rent to these new "illegitimate" frauds. They may also prepare false leases or rental agreements to make everything look official.

 They advertise houses they do not own for lease or rent on Craigslist or other sites for classified ads of rental properties. While the DRE is seeing the fraud discussed in this warning in connection with houses offered for rent, the crooks sometimes advertise apartments in this manner. Care should be exercised with respect to all rentals offered.

 

PLEASE DO NOT BECOME A VICTIM; THINGS TO DO TO PROTECT YOURSELF

There is rampant fraud occurring in the house rental market in some parts of California. The conartists are looking for quick, up-front monies to be paid to them many times over until they 

are stopped. Additionally, because these operators generally use false names, it is difficult to track them down and bring them to justice. Sometimes they set up bogus corporate, company or partnership names and the entities are just shells. Therefore, you must do your homework to avoid becoming victimized. It would be in your best interest to ask anyone offering a house for rent to provide you with proof that they own the house, and to show you their government issued picture identification. Then scrutinize the proof of ownership, as well as the identifications since there is also the risk that their identifications can be false.

If you think that you are dealing with an owner’s/ landlord’s representative, you should check with the DRE to see if that representative or agent is licensed. This is because a real estate license is required, with some narrow exceptions, for a person to offer a house for rent as an agent of the owner. Look up and check out the license records through the DRE web site (

www.dre.ca.gov) and make sure you are working with legitimate licensees.

If you are an existing tenant, you should check with the County Recorder’s office in the county in which you live to verify the property’s owner of record. If the house has been foreclosed upon, you should contact the new owner and verify with the current owner the person to whom you should be forwarding your rental payments.

If you are considering renting or leasing, consider the following before entering into a rental agreement and turning over your money:

 Check with the County Recorder to determine if the house being offered for rent has a Notice of Default recorded. If the property has been foreclosed, call the lender, servicer or owner to obtain the name of the company or individual who is their representative.

 Do as much research as you are able to avoid more financial loss and distress to you and your family.

 Be aware of those with fancy titles or claims of being connected to a legitimate person, business or the government.

SALVAGING CREDIT AND EQUITY IN ORANGE COUNTY CALIFORNIA REAL ESTATE!

 

The issue of pricing strategies was recently addressed here, particularly for facing moving deadlines or selling a home that's languishing on the market.  But what if you're experiencing financial hardship or losing valuable equity in your home?

 

If you're facing mortgage default and want to avoid foreclosure, you're probably looking at a short sale, an agreement with your lender to sell your home for less than what you still owe.  This pricing strategy is challenging, because you have to list high enough to satisfy the lender, but low enough to attract buyers.

 

First, complete a short sale application from your lender and get a quote for how much they're willing to accept.  Work with a reliable real estate agent to find the sweet spot between what the lender wants and what will excite buyers, and you may be lucky enough to receive multiple offers.

 

 

If you're not defaulting, but your home has lost significant value, you're still in a tough situation.  If you bought during the peak years, you may have trouble salvaging your equity in today's market.  While painful, the best pricing strategy in this case is to ask your agent for a Comparative Market Analysis (CMA) and price your home at fair market value or below.  Again, if your price is right, you may encourage multiple offers, resulting in a higher sale price.
